The Luncheon presentation provides an overview on how the Supreme Court of Canada recently addressed the issue of using previously expropriated lands for a new project in the case of Hydro-Québec v. Matta. The decision has potential implications for the future use and modification of infrastructure constructed within an existing right-of-way. It also provides insight as to how the scope of property rights acquired through the expropriation process may be modified or expanded to accommodate future infrastructure undertakings through post-expropriation agreements.
